Accepting These Terms

These Terms of Service and the other documents referenced in them comprise Favd's "Terms." These Terms are a legally binding agreement between you and Favd (as operated by Subkit, Inc.) governing your access to and use of the Services and setting out your rights and responsibilities when you use the Services.

By using any of our Services (including browsing Favd.co), you are agreeing to these Terms. If you do not agree to these Terms, please do not use or access the Favd Platform. If you will be using the Services on behalf of an entity (such as on behalf of your employer), you agree to these Terms on behalf of that entity and its affiliates and you represent that you have the authority to do so. In such a case, "you" and "your" will refer to that entity as well as yourself.

Who's Who

When these Terms use the term "Curator," we mean individuals using the Favd platform to create, manage, and share collections of products. Curators discover and showcase products they love, building themed collections that inspire and influence others in our community.

The term "Creator" refers to individuals who may earn through affiliate partnerships when their curated products lead to purchases.

"Users," "you," or "your" refers to anyone who uses our platform, whether as a Curator, Creator, or browse-only visitor.

Throughout these Terms of Service, 'Favd' refers to the platform operated by Subkit Inc., including its use of Collabs.io technology. Any references to 'we,' 'us,' or 'our' mean Favd and Subkit Inc. as the platform's operators and including its affiliates, subsidiaries, and each of their respective officers, directors, agents, partners, and employees. Favd operates as part of the Subkit, Inc. family of products and services.

Platform Technology

The Favd platform is powered by Collabs.io technology, a Subkit, Inc. product. By using Favd, you acknowledge and agree that certain platform functionality, data processing, and technical operations may be provided by or through Collabs.io's infrastructure and systems. While Favd operates using Collabs.io technology, all interactions, collections, and content shared on the platform occur within Favd. All such usage is subject to both these Terms and any applicable Collabs.io platform terms and policies.

Favd's Services and Role

What We Do

Favd's Services provide a comprehensive platform that empowers users to discover, curate, and share collections of products they love. At its core, our platform enables users to create personalized digital collections that showcase their unique taste and style preferences. Through our intuitive interface, users can organize and manage these collections by theme, category, or any other creative classification they choose, allowing for a highly personalized curation experience.

Our social discovery features form the backbone of the Favd community, facilitating connections between users with shared interests and aesthetic preferences. Users can explore curated collections from other members, gaining inspiration and discovering new products through the lens of trusted curators. The platform's social sharing capabilities extend beyond simple discovery, enabling users to share their collections across the Favd ecosystem and, where permitted, to external social platforms.

How We Fit In

Favd does not sell, manufacture, or fulfill any products listed on our platform. We provide a discovery and curation platform that allows users to share their favorite products and potentially earn through affiliate partnerships. All actual product purchases happen through third-party retailers or manufacturers.

For affiliate tracking and commission processing, Favd partners with established affiliate networks to ensure accurate attribution and timely payments to eligible Creators. Favd partners with established affiliate networks to track purchases from shared collections. However, Favd does not control third-party transactions and cannot guarantee purchase completion or pricing.

Your User Account with Favd

You will be required to create a User account to access certain features or functions of Favd Services, including creating collections, following other users, and engaging with the community. You agree to follow certain rules when you create an account with Favd or use the Services, including the following:

Age Requirements and Restrictions

• You must be at least 18 years of age, or the legal age of majority where you reside, to create an independent account on the Services.
• If you are between 13 and 18 years old, you may only use the Services under the supervision of a parent or legal guardian who manages your use and/or account. Your parent or guardian must review and agree to these Terms on your behalf.
• If you are under 13 years old, you are not permitted to use the Services or provide us with any personal information. We do not knowingly collect information from users under 13 years of age.

Account Information and Updates

• You agree to provide true, accurate, current, and complete information about yourself during the registration process (the "Registration Data").
• If you are using the Services on behalf of an entity (such as a business or organization), you must provide accurate information about that entity in your Registration Data.
• You are required to maintain and promptly update your Registration Data to keep it accurate, current, and complete.
• You agree to regularly review and update your profile information, privacy settings, and notification preferences to ensure they reflect your current preferences.

Account Security and Access

• You are responsible for maintaining the confidentiality of your account credentials, including your password.
• You agree to immediately notify Favd of any unauthorized use of your password or account or any other breach of security.
• You are solely responsible for (and we will hold you responsible for) any and all activities that occur under your account.
• You agree not to share your account credentials with any third party or allow others to access your account.
• You should use strong, unique passwords and enable any additional security features we make available, such as two-factor authentication if offered.

Indemnification

You agree to defend, indemnify and hold Favd, Subkit, Inc., Collabs.io, and each of their respective officers, directors, agents, co-branders, licensors, payment processing partners, other partners and employees, harmless from and against any and all damage (whether direct, indirect, incidental, consequential or otherwise), loss, liability, cost and expense (including, without limitation, reasonable attorneys' and accounting fees) resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator or otherwise) or investigation made by any third party (each a "Claim") relating to or arising out of:

• (a) your breach of these Terms (including any terms, agreements, or policies incorporated into these Terms);
• (b) your use of the Services in violation of these Terms or other policies we post or make available;
• (c) your breach of any applicable local, state, provincial, national or other law, rule or regulation or the rights of any third party;
• (d) the content you post, share, or transmit through the Services, including but not limited to product collections, comments, messages, and any other user-generated content;
• (e) your interactions with other users of the Services;
• (f) any misrepresentation made by you; and
• (g) your violation of any rights of another person or entity, including intellectual property rights.

Disclaimer of Warranties and Assumption of Risks

At Favd, we are committed to providing our Services to the best of our ability, but it is important for you to understand certain limitations and risks inherent in using our platform. To the extent permitted by applicable laws, the Services are provided on an "as is" and "as available" basis. Favd expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, title, non-infringement, and fitness for a particular purpose.

In using our Services, you should understand that Favd cannot and does not warrant that the Services will meet your specific requirements or expectations, nor can we guarantee that the Services will be uninterrupted, timely, secure, or error-free. The results you obtain from using our Services, including any product information, user content, or other materials, may not be accurate, reliable, or meet your expectations. Furthermore, we cannot assure that any errors in the Services will be corrected within any specific timeframe.

Limitation of Liability

To the maximum extent permitted by applicable law, Favd and its Associated Parties will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages. This encompasses a wide range of potential losses, including but not limited to damages for loss of profits or revenue, diminishment of goodwill or reputation, corruption or loss of data, disappearance of user collections or content, costs associated with obtaining substitute services, missed opportunities, and any other similar damages or intangible losses. This limitation of liability applies regardless of whether Favd has been advised of the possibility of such damages occurring and regardless of the theory of liability under which any claim might be brought.

For users who engage with our premium features or services, should any be offered, we further limit our total liability to the amount you have paid to Favd in the three-month period immediately preceding the circumstances that give rise to your claim. It's important to understand that Favd operates as a platform for content curation and sharing; we do not own, sell, or control the products featured in user collections. The responsibility for verifying product information and making informed decisions about external purchases rests solely with our users.
